- Cannot be a spouse
- Must be legally allowed to work in the U.S.
- Must be able to administer regular skilled and custodial services

- Patient must be a New York State resident
- Patient must have an ongoing medical condition
- Patient must require assistance with activities of daily living
- Patient must be able to hire and confirm your ability to care for them. If unable, they must have someone appointed to do so.
